At approximately 2:30 a.m., officers were dispatched to a shooting incident that had occurred on Cherokee Pond Court. Once on the scene, officers found a man lying in the front yard of a residence with multiple gunshot wounds.

Investigators say they contacted the man who told officers that he shot Fogle after an attack outside his home. He says Fogle approached him and chased him in his yard and garage before he was shot to end the altercation. Fogle threw Joseph Nicewonger to the ground and struck him in the head repeatedly.

Mortenson says other neighbors reported Fogle yelling and knocking on doors and his roommate said he was attacked.

The shooter did call 911 after the incident and stood in his yard until police arrived.

"The investigation continues and there has been no determination on charges", said Mortenson, adding Nicewonger has been cooperating with police.

Chief Terrence Green said, "This shooting is a tragedy and patience is appreciated while our Detectives work diligently through every aspect of this case to its conclusion".

Lexington Police are investigating a shooting at a shopping center that injured three people Monday evening.

Officers say more information will be available after the toxicology report is released.
