Sexual Assault Charges Dropped Against Hilary Duff's Ex-Husband Mike Comrie

Hilary Duff should be breathing a sigh of relief as her ex-husband Mike Comrie, the father of her son, is out of legal hot water, as Radar has confirmed.

We have learned that the former hockey player will not face rape charges after the prosecutors were unable to prove the encounter was non-consensual.

Comrie, who was divorced from Duff past year, and fathered her son Luca, 5, was embroiled in scandal after he was investigated for an alleged sexual assault at his Los Angeles residence in February, as Radar reported.

And now, reportedly prosecutors have cited "reasonable doubt" over the accusation of non-consensual anal sex.

She claims Comrie didn't stop when she asked him to, choked her and declared she couldn't tell him what to do, the report said. According to TMZ's report, the woman alleged that she and Comrie were having consensual sex until he began engaging in anal sex with her, which she says was not consensual.

The unnamed woman claimed she met the sportsman in a bar and they went back to his place where he raped her "multiple times".

"There is an open investigation of sexual assault involving Mr. Comrie", officer Liliana Preciado told the Daily News.

Police obtained that recording, and those that heard the audio say the tape reveals that Mike was definitely intoxicated, but that he also insists the accuser consented to the acts.

Comrie submitted a DNA sample for testing during the investigation while the woman was examined at a rape treatment center. The former couple finalized their divorce in January of previous year.

He and Duff married in 2010, and have a 5-year-old son, Luca, together.
