UCF fraternity member arrested on rape charge

A University of Central Florida student has been accused of raping a person during a party at his fraternity.

The victim, whose gender was not included in the report, told officers that on July 22, he or she and a friend attended a "New Year's in July" party at the Alpha Tau Omega fraternity house, which is on the campus.

According to an arrest report, the victim was attending the "New Years in July Party" on July 22 with friends and met Garces and a second man, whom police say is a UCF graduate.

Alexander Garces, a member of Alpha Tau Omega, was arrested Monday at the Alpha Tau Omega house and charged with false imprisonment and sexual battery according to UCFPD. He is being held at the Orange County Jail without bond.

The victim reported the crime to the UCF Police Department on Friday, August 4. They did not know the other man.

A few minutes after entering the room, Garces grabbed the victim by the legs, forcing him or her onto their back, the affidavit said. According to police, the victim performed a sex act on Garces, hoping that would prevent an assault. He then grabbed the person's hair, throwing him or her to the ground.

The victim punched Garces in the ribs during the attack.

"I've never seen you like this before, what's going on?"

The victim got separated from friends at one point, and was approached by Garces who asked the victim to go upstairs with him and the other man.

The victim told Garces, "I've been raped before, I'm not about to be in a situation like this. don't do this to me", according to the report.

Garces eventually left the room, but the other man then allegedly raped the victim and put his hands around the individual's throat and mouth to stop the screaming.

When he suddenly stopped and left the room, the victim fled the party.

The fraternity said on Tuesday that it had suspended Garces and was looking into the matter.

Garces was arrested Monday evening at the ATO house.

"Officials with the Alpha Tau Omega Fraternity learned of the police investigation on Saturday, and the chapter immediately suspended the man", the organization said in a statement.

'The alleged assault reportedly occurred during a July 22nd party at the chapter house. The "New Years in July" party was described by organizers as the "biggest on-campus party of the summer".
